Stronger measures against poor management<\/h2>\n\n\n\n<p>The reforms also introduce mechanisms under which a court-appointed administrator may manage certain poorly managed private or common areas.<\/p>\n\n\n\n<p>Local governments have also been given stronger tools to respond to condominiums that have deteriorated to a potentially dangerous condition.<\/p>\n\n\n\n<p>A condominium is not an asset that exists independently within the four walls of one apartment.<\/p>\n\n\n\n<p>The condition and management of the entire building matter.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Greater attention to conflicts of interest in management<\/h2>\n\n\n\n<p>Japan has seen increasing use of management structures in which a condominium management company also acts as the administrator or representative of the owners\u2019 association.<\/p>\n\n\n\n<p>This can create potential conflicts of interest when the same company is involved in transactions or construction work on behalf of the condominium.<\/p>\n\n\n\n<p>The revised framework therefore introduces disclosure requirements for certain transactions involving such potential conflicts.<\/p>\n\n\n\n<p>For buyers, this means it is increasingly important to understand not only <strong>which company manages the building<\/strong>, but also <strong>how the condominium association itself is governed<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What does this mean for foreign and overseas owners?<\/h1>\n\n\n\n<p>These changes are also relevant to foreign nationals and owners living outside Japan.<\/p>\n\n\n\n<p>For an overseas owner, participating in owners\u2019 meetings, exercising voting rights, communicating with the management company and reviewing important documents can be more difficult.<\/p>\n\n\n\n<p>When purchasing a condominium in Tokyo, therefore, it is important to look beyond the apartment itself.<\/p>\n\n\n\n<p>Consider reviewing:<\/p>\n\n\n\n<p>\u2022 How the owners\u2019 association is managed<br>\u2022 The long-term repair plan<br>\u2022 The balance and adequacy of the repair reserve fund<br>\u2022 Previous major repair works<br>\u2022 Planned future repairs<br>\u2022 Condominium bylaws<br>\u2022 Minutes of owners\u2019 meetings<br>\u2022 Any discussions concerning future redevelopment or owners\u2019 association.<\/p>\n\n\n\n<p>The other has postponed necessary repairs, has insufficient reserves and struggles to reach important decisions.<\/p>\n\n\n\n<p>Both may be described simply as \u201c30 years old.\u201d<\/p>\n\n\n\n<p>But they are clearly not the same property.<\/p>\n\n\n\n<p>When evaluating a resale condominium in Tokyo, it is therefore important
